NYT demands Microsoft and OpenAI eliminate any chatbot models and training data that have incorporated copyrighted material from the newspaper.

The newspaper seeks to hold the defendants accountable in the federal court in Manhattan for their unlawful actions of copying and utilizing The New York Times’s highly valuable works, requesting billions of dollars in both statutory and actual damages. The New York Times claims that it has reached out to OpenAI and Microsoft in April to discuss finding a friendly solution to the copyright problem, but their efforts were unsuccessful. OpenAI has managed to reach agreements with various other media outlets, such as the Associated Press and Axel Springer, the German owners of Politico and Business Insider, regarding the use of their content.

Susman Godfrey, the law firm that recently initiated a class action lawsuit against Microsoft and OpenAI, is also representing the newspaper. This law firm previously served as legal counsel for Dominion Voting Systems in their defamation lawsuit against Fox News concerning the 2020 US presidential election.

In a prepared statement, an OpenAI representative expressed respect for the rights of content creators and a strong commitment to collaborating with them, aiming to assist in their technological advancement and the exploration of new revenue models.

The spokesperson expressed their surprise and disappointment at this development, emphasizing the productive and constructive nature of their ongoing discussions with the New York Times. They also expressed hope for finding a mutually beneficial collaboration, as they are successfully doing with various other publishers.

All requests for comment went unanswered by Microsoft.
